Fairway Companion

1. Acceptance and eligibility

By installing, creating an account for, accessing, or using Fairway Companion, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the service.

You must be at least 13 years old and legally able to enter into these Terms. If local law requires a higher age for consent to online services, that higher age applies unless a parent or legal guardian validly consents.

2. The service

Fairway Companion provides golf venue discovery, downloaded course data, satellite map presentation, GPS distances, shot marking, practice tools, scorecards, statistics, achievements, profiles, friends, shared games, scheduling, Feed activity, notifications, and related features. Features may depend on your device, permissions, internet connection, venue data, Google services, or a supported watch.

Fairway Companion is currently offered free of charge, without ads or subscriptions. We may add, change, suspend, or discontinue features. If paid features are ever introduced, their price and terms will be disclosed before purchase.

3. Accounts

You are responsible for your account, connected Google account, phone verification, devices, session tokens, and activity performed through your account. Provide accurate information, keep access secure, and promptly revoke unfamiliar sessions in the Me tab.

You may delete synchronized cloud data or your account through the app. Account deletion is also available through the web process described in the Privacy Policy.

4. License

Subject to these Terms, Potato Studios grants you a limited, personal, revocable, non-exclusive, non-transferable license to install and use Fairway Companion on devices you own or control for personal, non-commercial golf activity.

Fairway Companion, its design, software, branding, course-overlay system, and original content are owned by Potato Studios or its licensors and are protected by applicable intellectual-property laws. No rights are granted except those expressly stated here.

5. Golf, maps, and safety

Fairway Companion is an informational aid, not a substitute for your judgment, official course markings, posted rules, a rangefinder approved for competition, emergency services, or instructions from golf-course staff.

• GPS, elevation, map imagery, course geometry, weather, yardages, hazards, tee positions, flags, and venue details may be delayed, incomplete, or inaccurate.
• Always confirm your target and surroundings before swinging or moving. Do not look at or operate the app while driving a vehicle or cart when doing so would be unsafe or unlawful.
• Do not enter closed, private, hazardous, or restricted areas because a map appears to show a route.
• You are responsible for compliance with course rules, tournament rules, device restrictions, and applicable law.

6. Social features and user content

You may provide profile photos, display names, scores, reactions, schedule details, venue submissions, map reports, and other content ("User Content"). You retain ownership of your User Content. You grant Potato Studios a worldwide, non-exclusive, royalty-free license to host, reproduce, process, display, and distribute it only as needed to operate, secure, improve, and provide Fairway Companion.

You represent that you have the rights needed to submit User Content. Do not submit unlawful, deceptive, abusive, harassing, infringing, private, or malicious content. Do not impersonate another person, manipulate scores or friend discovery, spam players, scrape profiles, or use shared-game links to harass or monitor others.

We may remove content, restrict social features, or suspend accounts when reasonably necessary to enforce these Terms, protect users, respond to legal requests, or secure the service. Blocking and reporting tools do not guarantee that every unwanted interaction will be prevented.

7. Course and venue submissions

Venue information and map-correction submissions may be reviewed, combined with reports from other users, rejected, or applied to shared course data. Temporary flag observations may expire. Permanent corrections may remain as non-personal course geometry even if the reporting account is later deleted.

Do not submit fabricated locations, copyrighted material you lack permission to use, or corrections made while you are not safely and lawfully present at the venue.

8. Prohibited conduct

You may not:

• use Fairway Companion for unlawful, fraudulent, unsafe, or abusive activity;
• attempt to access another account, non-public data, or restricted service infrastructure;
• bypass Play Integrity, authentication, rate limits, access controls, or API-key restrictions;
• introduce malware, disrupt the service, automate abusive requests, or overload Fairway Cloud;
• reverse engineer or distribute modified copies except to the limited extent applicable law expressly permits; or
• use Fairway Companion or its data to create a competing venue database, surveillance product, advertising profile, or data-broker product.

9. Third-party services

Fairway Companion relies on or links to services including Google, Cloudflare, Telnyx, Open-Meteo, Android, Google Play, golf venues, reservation providers, calendars, messaging apps, and phone services. Their products are governed by their own terms and policies. Potato Studios does not control their availability, accuracy, pricing, security, or decisions.

10. Pre-release software

Testing builds may contain unfinished features, defects, design changes, data resets, compatibility problems, and interruptions. Do not rely on pre-release builds as your only copy of important information. Features shown in testing may change before public release.

11. Suspension and termination

You may stop using the service at any time and may delete your account. We may suspend or terminate access if you materially violate these Terms, create risk or legal exposure, abuse other users, or threaten the service. Where reasonable, we will provide notice or an opportunity to correct the issue.

Sections that by their nature should survive termination, including ownership, disclaimers, limitations of liability, and dispute provisions, will survive.

12. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, FAIRWAY COMPANION IS PROVIDED "AS IS" AND "AS AVAILABLE." POTATO STUDIOS DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the service, maps, distances, weather, venue information, social content, notifications, or third-party services will be accurate, complete, uninterrupted, secure, or error-free. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, POTATO STUDIOS AND ITS MEMBERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST DATA, PROFITS, GOODWILL, OR OPPORTUNITIES; PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM UNSAFE USE; OR LOSSES CAUSED BY INACCURATE MAPS, DISTANCES, WEATHER, VENUE DATA, USER CONTENT, OR THIRD-PARTY SERVICES.

TO THE FULLEST EXTENT PERMITTED BY LAW, POTATO STUDIOS' TOTAL LIABILITY ARISING OUT OF FAIRWAY COMPANION WILL NOT EXCEED US $100. These limits do not apply where prohibited by law or to liability that cannot legally be limited.

14. Indemnity

To the extent permitted by law, you agree to defend and indemnify Potato Studios from third-party claims, damages, and reasonable costs arising from your unlawful use of Fairway Companion, your User Content, or your material violation of these Terms. This section does not require indemnification for Potato Studios' own unlawful conduct.

15. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute not resolved informally will be brought in a court of competent jurisdiction in California, unless applicable consumer law requires another forum. Nothing in these Terms limits rights you cannot waive under applicable law.

16. Changes

We may update these Terms as the service changes. We will update the effective date and provide additional notice when required. Your continued use after updated Terms take effect means you accept them.

17. General

These Terms and the Privacy Policy are the entire agreement concerning Fairway Companion. If one provision is unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; Potato Studios may transfer them as part of a merger, reorganization, or sale of the service.
